LEI MARIA DA PENHA: Da idealização teórica à eficácia prática em tempos de isolamento social

Abstract

The present work arises from the recurrence of cases of domestic violence in times of social isolation, considering that the coping measure adopted by the State restricts the freedom of individuals, forcing victims to spend more time with their aggressors. The bibliographical framework adopted in this study clarifies the influence of patriarchy on the bases of civil society and its influence on public policies adopted to combat domestic violence, directly intervening in its (de)efficiency. The issue of this study refers to the worsening of domestic violence during the pandemic. Thus, the objective was to analyze the influence of patriarchy in combating domestic violence, as well as highlight the relationship between the pandemic and the increase in cases of domestic violence, indicating social media as potential instruments of denunciation. At the end of the study, it was found that there are several problems arising from the pandemic, in such a way that they increased the commission of crimes provided for in law n. 11,340/2006, and that the implemented public policies require adjustments to, in fact, guarantee the protection of women.
