OS PARÂMETROS DA LEGISLAÇÃO AGRÁRIA E A EQUIDISTÂNCIA COM O DESENVOLVIMENTO SUSTENTÁVEL EM ASSENTAMENTOS RURAIS NO BRASIL

Abstract

The present work is important, since it is essential to analyze the rights of children and the role of the State in the re-socialization of minor offenders, given that Brazil has gone through several moments in which children's rights were not recognized. In this sense, through a review of the bibliography and a case study, based on a qualitative and analytical research, we sought to present the historical trajectory in which children's rights were implemented in a legal text. In this perspective, the objectives outlined were to demonstrate education as a tool for the resocialization of young offenders and to verify the socio-educational measures adopted after the commission of criminal offenses and to expose the role of the State in the resocialization of these adolescents. Furthermore, the research reported the laws that emerged in the face of brutal crimes committed against children in which part of the responsibility lies in the State's failure to take actions that focus attention on the integral protection of children, such as the Menino Bernardo Law. Thus, the research exposed situations in which the State was silent, and the problem ends up perpetuating not having effective security measures and full resocialization offered to minors.
