A INVERSÃO DE CULPA EM CRIMES DE ESTUPRO

Abstract

The present work intends to analyze the crime of rape from the perspective of the inversion of the guilt regarding discrimination and prejudice against women, naturalizing and justifying sexual violence. To do so, it started from the following question: Why does the rape trial mobilize an interrogation about the possible guilt of the victim? In this sense, in order to answer this question, the study addressed the concept and historical evolution of rape and the inversion of guilt in cases of rape. As a research methodology, the bibliographic review was adopted, as it is based on a survey of theoretical references that have already been analyzed and published electronically, such as books, scientific articles, website pages, and a case study, because from the moment the victim is attacked until a possible trial, many facts cause her to be exposed and humiliated in several different ways, in addition to all the trauma of the criminal act itself. The methodology concerns the paths adopted and taken to reach a certain end. It is she who will outline the trajectory of scientific research.
