ALIENAÇÃO PARENTAL: a guarda compartilhada como prevenção

Abstract

The present work is guided by the need to protect the rights of children and adolescents in the face of marital separation, considering that it is not always friendly, and the inadequate way of dealing with the situation can trigger parental alienation. A subject that, despite not being recent, still lacks understanding and awareness, given the seriousness of the damage that can be caused to individuals undergoing personality formation, which may have repercussions throughout their lives. Thus, the objective is to demonstrate that the family is the basis of society, and constitutes one of the primary

objectives of humanity, with a constitutional provision in the caput of article 226. Furthermore, the rights of parents in relation to their children are highlighted, with emphasis of active and solidary participation. To obtain this result, exploratory and qualitative research was carried out, while different areas were explored to reach the main point, as well as an inductive analysis of the theme, through a bibliographic procedure. It also has an applied research nature, as it generates knowledge that can be applied in practice. At the end of the study, after analyzing the types of custody, it appears that shared custody can act directly to prevent the practice of alienation, being the one that best guarantees the interests of minors.
