A INFLUÊNCIA DA MÍDIA NAS DECISÕES PROFERIDAS PELO CONSELHO DE SENTENÇA NO TRIBUNAL DO JÚRI E SUAS IMPLICAÇÕES NA APLICAÇÃO DO DIREITO

Abstract

This research emerged with the aim of analyzing the possibility of media influence in the decisions of the jury court jurors, investigating the consequences that such influence would imply in the application of the law and constitutional principles, especially the adversarial and broad defense. Through the inductive method, based on the bibliographical study, initially, the historical and evolutionary context and the general aspects related to the jury trial were briefly discussed. Then, the media coverage of cases judged by the popular jury started to be exposed, bringing examples of Brazilian cases that marked the popular imagination, highlighting the role played by the press in each one of them. Finally, the constitutional principles that affect the popular court were covered, with the approach of positions of various scholars on the topic proposed in the research, concluding that the news media aim at profitability and use sensationalism to captivate the public, influencing not only the jurors, but from the whole society, building a preconception before the trial of the accused.
