DIGNIDADE DA PESSOA HUMANA DOS ENCARCERADOS NO BRASIL

Abstract

This article was carried out based on current legislation, as well as through legal articles, envisioning the Brazilian prison system, and its peculiarities, such as: the rights and duties of penitentiaries, their motivations for committing infractions, the society that welcomes the individual back after serving the sentence. It can be said that there are several reasons that corroborate the lack of dignity of the human person, effectively on the part of the State, the inertia is clear, there is no movement for the resolution of such disorder. Overcrowding, ineffective medical assistance and precise actions that re-socialize inmates contribute to the chaos that is installed in the Brazilian penitentiary system. Performing a scan, it was clear and evident the violation of fundamental human rights in Brazilian penitentiaries, in addition to non-compliance with constitutional and infra-constitutional provisions. For the realization of this article, the bibliographic methodology was used, based on the consultation of legal norms, the Federal Constitution, among other devices.
