TRABALHO INFANTIL: A ineficácia da legislação frente a realidade dos fatos sociais

Abstract

The present work deals with the exploitation of labor arising from child labor in Brazil, as there is still plenty in the country regarding the subject. The methodology used for this research was bibliographical, supported by legislation and doctrine. The culture of “working since childhood” is still rooted in the population, in addition to the fact that poverty sometimes acts as a coercive force, leading the individual to work early in order to survive. It is notorious that it affects, in greater numbers, the most vulnerable part of Brazilian society, that is, the poorest people financially. The protection of children and adolescents is of a family nature, involving society in this responsibility, and the fundamental guarantees for their development are supported by the State. The State fails when it is unable to supervise or support this activity to end. Although the country has legislation and social programs that aim to protect children and adolescents against child labor abuse, it was evident that it is not being effective, a clash between the reality of the facts and the legislation. However, there are more questions discussed below about this past past theme.
